Libby is Commuted!

WASHINGTON (AP) - Just when things looked darkest for I. Lewis "Scooter" Libby, when prison seemed all but certain, President Bush wiped away the former White House aide's 2 1/2-year sentence in the CIA leak case. Bush's move came Monday, just five hours after a federal appeals panel ruled that Libby could not delay his prison term. His prospects for an emergency appeal to the Supreme Court seemed bleak. The former chief of staff to Vice President Dick Cheney, Libby was just waiting for a date to surrender. After months of sidestepping pardon questions, Bush stepped in. He did not issue a pardon but erased a prison sentence that he felt was just too harsh. "I respect the jury's verdict," Bush said in a written statement. "But I have concluded that the prison sentence given to Mr. Libby is excessive. Therefore, I am commuting the portion of Mr. Libby's sentence that required him to spend 30 months in prison."

Kerry joins 'Fairness Doctrine' chorus

John Kerry openly stated his support of the overturned "Fairness Doctrine" that required broadcasters in America to "afford reasonable opportunity for the discussion of conflicting views of public importance." The Federal Communications Commission overturned the rule in 1987 because it failed to accomplish its purpose of encouraging more discussion of controversial issues. More notably, concerns were raised over the constitutionality of the doctrine because many believed it violated First Amendment free speech rights. "I think the fairness doctrine ought to be there, and I also think equal time doctrine ought to come back," he said on the Brian Lehrer show on WNYC. Kerry's remarks can be heard in a recording posted by the Drudge Report.

Two Supreme Court Decisions Are Victories for Faith-Based Groups

In a decision issued by the Supreme Court prior to a summer recess, the court ruled in a 5-4 decision that taxpayers cannot challenge a White House initiative that helps religious charities receive federal funds. The case of Hein v. Freedom From Religion Foundation is a “victory for President Bush’s faith-based imitative,” said Jay Sekulow, chief counsel for the American Center for Law and Justice (ACLJ). According to Sekulow, in the Hein case, taxpayers challenged a federal faith-based program in Wisconsin. The court in Wisconsin dismissed the case ruling the taxpayers had no standing, as there was no federal grant at stake. However, a federal appeals court reinstated the ruling and the government then appealed to the Supreme Court. Sekulow, whose ACLJ filed a friend-of-the-court brief in support of the government, pointed out that “no federal taxpayer suits are allowed in any other context aside from Establishment Clause suit challenging federal spending.

Atlanta officials declare Constitution-free zone

The city of Atlanta has created a Constitution-free zone on public property for this weekend's 2007 Atlanta Pride festival, according to pastors and lawyers who have been trying to secure an assurance that Christians' free-speech rights will be protected. "The Constitution does not apply in Piedmont Park this weekend," attorney Joel Thornton, of the International Human Rights Group told WND.

Broadcasters Win Expletive Dispute With FCC

A court ruling on a new federal policy against the accidental use of profanities on TV and radio may complicate government efforts to impose indecency fines. "Practically, this makes it difficult to go forward on a lot of the cases that are in front of us," Federal Communications Commission Chairman Kevin Martin told The Associated Press after the 2nd U.S. Circuit Court of Appeals ruled against the FCC on Monday in a case involving two Fox Television shows.

U.S. probes Google deal on DoubleClick

WASHINGTON, May 28 (UPI) -- The Federal Trade Commission has launched an investigation into Google's plan to purchase DoubleClick Inc. for $3.1 billion, The New York Times said. Citing an industry executive who had been briefed on the FTC's preliminary antitrust investigation, the newspaper said the inquiry was opened last week after it was determined that the commission, rather than the Justice Department, should conduct the review. An FTC spokesman Monday told the newspaper the commission does not comment on pending inquiries.

Bush to pressure Senate to revive U.N. sea treaty

WASHINGTON – In a move that has already angered some of his most ardent supporters, President Bush has asked the Democratic leadership in the U.S. Senate to revive a proposal for ratification of the United Nation's Law of the Sea Treaty, an international agreement defeated two years ago by Republican leadership in the upper house. Critics say ratification would compromise U.S. sovereignty and place 70 percent of the Earth's surface under the control of the U.N. – even providing for a "tax" that would be paid directly to the international body by companies mining in the world's oceans.

House Votes To Expand Hate Crimes Law

(AP) Just hours after the White House issued a veto threat Thursday, the House voted to add gender and sexual orientation to the categories covered by federal hate crimes law. The House legislation, passed 237-180, also makes it easier for federal law enforcement to take part in or assist local prosecutions involving bias-motivated attacks. Similar legislation is also moving through the Senate, setting the stage for another veto showdown with President Bush.

Imus firing back at CBS

NEW YORK (CNN) -- Former radio talk show host Don Imus has hired one of the country's top trial lawyers to sue CBS Radio following his dismissal last month for making racial and sexual on-air comments about members of the Rutgers University women's basketball team. Attorney Martin Garbus told CNN Wednesday that he has agreed to represent Imus in a wrongful breach of contract suit against his former employer. Garbus would not disclose when he was retained by Imus but said he plans to file an action against CBS in the near future. Calls made to Imus by CNN were not returned.

Will Bush veto 'thought police'?

The nation's largest public policy women's group is asking President Bush to commit to a veto of a "hate crimes" plan that, as WND has reported, opponents fear would target Christians and be used to demolish both freedom of speech and religion in the United States. "Last week the House Judiciary Committee, egged on by radical homosexual groups, passed what can only be called a Thought Crimes bill," said former White House insider Chuck Colson in his Breakpoint commentary. "It's called the Local Law Enforcement Hate Crimes Prevention Act. But this bill is not about hate. It's not even about crime. Police to Review Clash at LA Rally

LOS ANGELES (AP) - Police Chief William J. Bratton on Wednesday promised an investigation into the conduct of police who dispersed an immigration rally, after videos captured officers using force with reporters and firing rubber bullets into crowds. Bratton said officers fired 240 "nonlethal" rounds to clear MacArthur Park late Tuesday. News images showed police hitting a television cameraman to the ground, shoving people who were walking away from officers and injuries from the rubber bullets, including a Hispanic man with welts on his abdomen and back. Lines of officers moved through the park firing the rubber rounds. "The events of yesterday, with all (the training) that we do, should not have occurred," Bratton said at a tense news conference. "We should not be engaged in attacks on the media."

Conservative Black Pastors Fight Bill on Hate Crimes

A coalition of conservative African American pastors is lobbying Congress to vote against a bill that would extend federal hate-crimes laws to cover gays, saying they fear it would prevent them from preaching against homosexuality. Several pastors last week urged House Judiciary Committee Chairman John Conyers Jr. (D-Mich.), a sponsor of the bill, and other members of the Congressional Black Caucus to vote against the proposed Local Law Enforcement Hate Crimes Prevention Act.

Google and MySpace Expanding in China

Google and MySpace are increasing their efforts to establish themselves in China, the second-largest Internet market behind the United States. Google Inc., No. 2 in China's Web search market, is giving its local managers more autonomy and investing more in China in an effort to make up for its late entry and take the lead in the industry, Chief Executive Officer Eric Schmidt said Friday. "We are catching up. Our investment is working and we will eventually be the leader," he told reporters.

Don Imus' Longtime Producer Fired

NEW YORK — The longtime producer for Don Imus' syndicated radio show joined his boss on the unemployment line one week after the disgraced broadcaster was booted from the airwaves for racist and sexist comments about the Rutgers women's basketball team. Bernard McGuirk, who joined the "Imus in the Morning Show" as producer in 1987, was let go late Thursday by WFAN-AM for his role in the ugly incident, CBS Radio spokeswoman Karen Mateo said Friday. CBS Inc. (CBS), the parent company for WFAN, pulled Imus off the air on April 12.

Google, Utah on Collision Course Over Web 'Keywords'

Google "Utah Legislature" and "lawsuit" and you might soon find yourself reading about, well, Google. The world's largest Internet search engine says a new state law that curbs keyword-triggered advertising is unconstitutional and probably will be challenged in court. And although the company didn't promise to be the plaintiff, its spokesman pledged to work with other Internet companies to "educate officials in Utah about the numerous consequences" of the legislation.
